Sitters2Go User Agreement - You Must Read & Accept Our Agreement ACCEPTANCE OF TERMS THROUGH USE This agreement contains all of the terms and conditions ("Terms") between Nanny4U, Inc ("Sitters2Go.com") and you ("User") and governs the use of the services offered at the Sitters2Go.com Web Site ("Site"). Please read this Agreement before using the Site. Use of the Site constitutes an agreement to these Terms. By using this Site, all Users do hereby represent, warrant, understand, agree to and accept all terms and conditions contained herein. Do not use this Site if you do not agree to these Terms. We reserve the right, at our discretion, to update or revise these Terms. Please check the Terms periodically for changes. Your continued use of this Site following the posting of any changes to the Terms constitutes acceptance of those changes. ACCEPTANCE TO RULES OF CONDUCT You agree to abide by Sitters2Go.com's Rules of User Conduct, including but not limited to, agreeing not to use this Site for any unlawful purpose. A copy of the Rules of User Conduct, which you should review, can be found at http://Sitters2Go.com/conduct USE OF INFORMATION AND SERVICES Sitters2Go.com.com is a communications platform for enabling the connection between Parents seeking Childcare Providers ("Parents") and Childcare Providers seeking to provide childcare services ("Childcare Providers"). The Childcare Providers listed on the Site are listings only and are not recommendations or referrals. The information provided by Sitters2Go.com is believed to have come from reliable sources, including the individuals and facilities themselves or those sources open to the public. Users do hereby represent, understand and expressly agree that Sitters2Go.com does not have control over the quality, timing, legality or any other aspect whatsoever of the services actually delivered by the Childcare Providers, nor of the integrity, responsibility or any of the actions whatsoever of the Parents, Childcare Providers, and any other User of the Site. All Users, including both Parents and Childcare Providers, do hereby expressly agree not to hold Sitters2Go.com, its franchises, officers, directors, employees, agents and third parties liable for any instruction, advice or services delivered which originated through the Site and Sitters2Go.com expressly disclaims any liability whatsoever for any damage, suits, claims, and/or controversies that have arisen or may arise, whether known or unknown there from. TRANSACTIONS Parents may seek the services of a Childcare Provider through the use of the Site and Childcare Providers may submit information about their services to list on the Site. Parent and Childcare Provider must deal directly with each other to resolve any disputes. Sitters2Go.com will not be held responsible and expressly disclaims any liability whatsoever for any claims and controversies that may arise for any disputes between any Users. By using this Site, you do hereby represent, understand, and expressly agree to hold Sitters2Go.com harmless for any claim or controversy that may arise from any disputes between Users of the Site. SITTERS2GO.COM IS ONLY A VENUE Sitters2Go.com is a communications platform for enabling the connection between Parents and Childcare Providers. Sitters2Go.com does not take part in the interaction between Parents and Childcare Providers except to collect payments on the behalf of Parents for venue services through the Site. Sitters2Go.com does not have control over the quality, timing or legality of services actually delivered by its Childcare Providers and Parents. Sitters2Go.com makes no representations about the suitability, reliability, timeliness, and accuracy of the childcare provided by Childcare Providers or Parents through the Site whether in public, private or offline interactions. Due to the nature of the Internet, Sitters2Go.com cannot confirm that each Childcare Provider or Parent is who they claim to be. Sitters2Go.com does not assume any responsibility for the accuracy or reliability of this information or any information on this Site. Sitters2Go.com does not assume and expressly disclaims any liability that may result from the use of this information. RELEASE Because Sitters2Go.com is not involved in the actual contact between Users, in the event that you have a dispute with one or more Users, you release Sitters2Go.com franchises, officers, directors, employees, agents and third parties from claims, demands or damages (actual or consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. THIRD PARTY VERIFICATION SERVICE Sitters2Go.com may put Users through a third-party verification service. Users of the site may use this service to verify information such as, but not limited to, name, address, social security number, and criminal background. Use of a third-party verification service is voluntary. If you decide to use or access information provided by a third-party verification service offered through the Site, you do hereby represent, understand and expressly agree that Sitters2Go.com is a conduit for the third-party verification service and does not monitor and does not have control over or assume any responsibility for the quality, accuracy, or reliability of the information provided by the third-party verification service. FAIR CREDIT REPORTING ACT If you decide to use or access information provided by a third-party verification service offered through the Site, you warrant that you will comply with the Fair Credit Reporting Act ("FCRA"), which can be found at http://www.ftc.gov/os/statutes/fcradoc.pdf. Sitters2Go.com is merely a conduit for the information returned from a Verification Service, and in no way participates in, nor has control of, the use of that information. Sitters2Go.com does not assume and expressly disclaims any liability that may result from the use of information provided by a third-party verification service. BILLING AND PAYMENT POLICY Users are obligated to pay for the service of the Site, unless specifically notified otherwise. Members that sign up will pay a subscription fee and incur subscription charges on a reoccurring basis for Sitter services. Unless canceled by you as provided below, you will be automatically billed each period. While Sitters2Go.com will use its best efforts to ensure the privacy of all credit cards and all other personal information, we expressly disclaim any liability for any damage that may result should any information be released to any third parties. User does hereby agree to hold Sitters2Go.com harmless for any damages that may result there from. Sitters2Go.com will use a third party service to process your credit card payments. CANCELLATION If you would like to cancel your account, log into your Sitters2Go.com account and click the 'Account Status' tab in the 'Manage My Account' section. Please note that we do not prorate subscription fees. MONEY BACK GUARANTEES Due to the nature of its service, Sitters2Go.com does not provide a money back guarantee. REFUNDS Sitters2Go.com will process refunds or credits for our errors or other extenuating circumstance. Account cancellation requests received after the account has been billed will not qualify for a refund. COMPLIANCE WITH THE CHILDREN'S ONLINE PRIVACY PROTECTION ACT OF 1998 Sitters2Go.com is intended for individuals 16 or over. We have made an effort to specifically limit Sitters2Go.com appeal to individuals of age 16 or over. Sitters2Go.com will not knowingly collect any information from children under 16. If you are a Childcare Provider, you must identify your age during the registration process. Sitters2Go.com takes the Children's Online Privacy Protection Act of 1998 (COPPA) as well as all FTC regulations very seriously. We are also strong supporters and maintain strict compliance with the Rules and Regulations set forth there under. That being said, we do not assume any responsibility for any misrepresentations regarding a Childcare Provider's age or parental consent when using this Site. Should we determine that a Childcare Provider provided any false information to us when using this Site, the Childcare Provider's membership will be terminated immediately. THIRD PARTY WEBSITES This Site may produce automated search results or otherwise link you to other sites on the Internet. These sites may contain information or material that some people may find inappropriate or offensive. These other sites are not under the control of Sitters2Go.com, and you acknowledge that Sitters2Go.com is not responsible for the accuracy, copyright compliance, legality, decency, or any other aspect of the content of such sites AND THAT Sitters2Go.com makes no representations regarding these sites. The inclusion of such a link does not imply endorsement of the site by Sitters2Go.com or any association with its operators. Sitters2Go.com cannot ensure that you will be satisfied with any products or services that you purchase from a third-party site that links to the Sitters2Go.com Site because these sites are owned and operated by independent companies and/or retailers. You also warrant that the holder of any rights, including moral rights, has validly and irrevocably granted you the right to grant the license to us stated above. If any part of these Terms is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect. TERMINATION Sitters2Go.com reserves the right, in its sole discretion, to terminate your access to all or part of this Site, with or without cause and/or notice. Sitters2Go.com reserves the right, at its sole discretion and without liability to you, to immediately terminate your ability to access the Site and/or any other service we may provide to you, with or without cause. Without limiting the foregoing, we may terminate your access if we learn you have provided false or misleading information, interfered with other Users or the administration of our services, or otherwise not complied with any of these Terms.
